Welcome to Fox Chase Villas

Hello and welcome to Fox Chase Villas. This information packet has been created to help answer common questions you may have about living here. Registered owners can find more information elsewhere on this website.

History: The Fox Chase Villas COA was created in 2018 by Bielinski Homes, the builder of the 30 condos here. The first phase, consisting of the three buildings along Markham Road, were completed and occupied starting in September 2019. The second phase, consisting of the three buildings on the north side of Margo Circle, were completed and occupied starting in February 2021. Since phase two, construction has been continuous and the six buildings on the eastern stretch of Margo Circle were completed and occupied in 2022/2023. Occupancy of the final three buildings, on the south side of Margo Circle, began in June 2023. Construction was completed before the end of 2023. No future expansion of this property is expected.

The COA transitioned from builder-managed to owner-managed in July 2023. Three condo owners now volunteer to manage the COA, which includes collecting dues, paying bills, banking and finances, budgeting, contracting for services, enforcing bylaws, addressing maintenance and other issues, etc.

Warranty Issues: First time owners of a newly built condo have a one-year warranty with Bielinski Homes, where Bielinski is responsible for all interior and external issues with your condo, including issues with your walls, ceilings, floors, basements, siding, windows, doors, plantings adjacent to your condo, etc. For warranty issues, contact Bielinski directly at [email protected], or 262-542-9494. 

Once the one-year warranty for your condo has expired you are responsible for maintaining the interior of your condo but contact COA management for all external maintenance issues.

Governing Documents: You received a copy of the governing documents of this COA during your purchase/closing, and they are available on our website. The governing documents include the Articles of Incorporation and the Declaration of Condominium, which legally define the condo association, and the Association Bylaws, which are the COA rules we have all agreed to live by when purchasing our condo.

We are all legally bound by the bylaws and rules defined in the governing documents. Some of the important responsibilities defined in the governing documents follow. See the original governing documents for more details.

  1. Units: Your unit is your condo, the only part of the COA that you own exclusively. It consists of the interior walls, ceilings and floors, all windows and doors, and your garage. You are responsible for all routine maintenance and repair of everything within your unit, except while under warranty. Any structural changes within your unit must be reviewed and approved by COA management prior to making any changes.
  2. Common Elements: Everything outside of your unit is a Common Element, owned and managed by the COA. As a member of the COA, you own a part (1/30th) of all common elements, but you may not modify common elements without prior approval by COA management. There are two kinds of common elements:
    1. Limited Common Elements: These common elements are reserved for the exclusive use of the unit owner/occupant. These include your patio/deck, front porch/stoop, and driveway.
    2. General Common Elements: This is everything other than your unit and the limited common elements associated with your unit. Examples of general common elements include external walls, roofs, gutters, external lighting, sidewalks, lawns, planting beds, septic systems, Margo Circle, guest parking, etc.
  3. Your Responsibilities for Common Elements: 
    1. You are responsible for keeping in good condition the Limited Common Elements associated with your unit.
    2. You are responsible for watering the lawn areas and landscaping located adjacent to your unit. Watering is especially important for new sod and planting beds.
    3. Within limits, this COA allows you to add plants or lawn decorations to the planting beds adjacent to your unit. However, note that the planting beds are maintained by contractors hired by the COA, including mulching, spring and fall cleanups, weeding, pruning and replacement of dead plants, and your plantings will be affected by this regular maintenance, and your decorations must not interfere with these maintenance activities.
    4. Within limits, this COA allows you to add plants or lawn decorations to the planting beds around the septic systems. However, note that these plantings are maintained by the COA, and all septic systems are inspected twice per year, and pumped as needed, and your plantings may be affected by this work, and your decorations must not interfere with this work.
    5. All replacements of exterior items such as windows and doors shall be made in uniformity with the exterior features of the other buildings in the COA. Any such changes to your unit must be reviewed and approved by COA management prior to making any changes.
  4. COA Responsibilities for Common Elements:
    1. All repairs and maintenance of Limited Common Elements such as driveways and decks, shall be managed and performed by the COA.
    2. All repairs and maintenance of General Common Elements shall be managed and performed by the COA.
    3. Contractors hired by the COA for lawn care, planting maintenance, snow removal, etc. are bound by contracts that define the work to be performed. Please do not ask contractors to adjust their activities to suit your wishes. The COA is responsible for and liable for the work they perform.
    4. If you have concerns about how the Common Elements are managed/maintained, please contact COA management.  

Other Topics:

Storm Doors: Adding storm doors to your unit is a common request but must be approved in advance by the COA. Contact COA management to request approval for installing a storm door. You will be provided with a packet describing the specifications for the type and color of the door that meets the COA requirements.

Guest Parking: Visitors/guests should park in your driveway, or in the visitor parking spots located by the mailboxes on the north side of Margo Circle, or by the southeast corner of Margo Circle. Any guest parking must ensure that traffic, snow removal, etc. on Margo Circle is not blocked. 

Paying Association Dues: After your closing documents are received by COA management, you will be added to the monthly invoice schedule for dues payments. Invoices are sent via email on the last day of the month, and dues - currently $300.00 per month – are due on the first of the month.

Depending on when the sale of your unit closed, you might owe full or partial dues for your first month here. Contact the COA via email if you have questions and we’ll work on getting you set up.

You can pay your association dues by check, mailed to the address above, or electronically by bank transfer/ACH using the invoice you receive by email. Do not pay dues electronically using a credit/debit card – the fees associated are too high and we will be forced to bill you for the additional fees charged if you use this payment method.

Water Softeners: The water in Eagle is hard and many of us are using water softeners. There are many companies in the area that can help you with this, including Culligan, Guthrey & Frey, Dalee Water Conditioning and others.
